European Commission Reviews Automotive Antitrust Rules Amid Market Shifts

The European Commission has initiated a public consultation to assess the functioning of competition rules applicable to vertical agreements in the automotive sector. This process focuses on the Motor Vehicle Block Exemption Regulation (MVBER) and the Supplementary Guidelines (SGL), both updated in April 2023, as well as the Vertical Block Exemption Regulation (VBER) and related guidelines. The MVBER and SGL provide a framework for companies to assess the compatibility of their vertical agreements with EU competition law, specifically Article 101(1) of the Treaty on the Functioning of the European Union (TFEU). These rules are set to expire on 31 May 2028, prompting the need for evaluation to ensure they remain relevant amidst rapid market changes.
